Welcome to Lettucesell (“we,” “us,” or “our”). These Terms & Conditions govern your use of our resale, consignment, and liquidation services. By engaging with Lettucesell, you agree to comply with these terms.
1. Definitions
- “Client” – You, the individual or business using our services.
- “Items” – Goods submitted for sale through Lettucesell.
- “Commission” – Our fee, typically 20-50% of the final sale price (varies by item).
- “Platforms” – Third-party marketplaces (e.g., eBay, Facebook Marketplace) where we list items.
2. Our Services
What We Do
- List, market, and negotiate sales of your items.
- Provide estimated valuations (non-binding).
- Handle payments and shipping (if applicable).
What We Don’t Do
- Guarantee sale prices or timelines.
- Purchase items directly (we act as your agent).
- Accept prohibited items (see Section 5).
3. Client Responsibilities
You agree to:
✔ Accurate Descriptions – Disclose defects, authenticity, and ownership.
✔ Legal Ownership – Confirm items aren’t stolen, counterfeit, or restricted.
✔ Timely Communication – Respond to offers/inquiries within 48 hours.
4. Fees & Payments
- Commission: Deducted from sale proceeds (rate disclosed before listing).
Payouts: Issued via Zelle, Venmo, or check within 3-5 business days after sale.- No Upfront Fees: You pay only if/when your item sells.
5. Prohibited Items
We do not accept:
❌ Firearms, weapons, or ammunition
❌ Recalled or hazardous materials
❌ Counterfeit/replica goods
❌ Items violating intellectual property rights
6. Disputes & Liability
- Market Fluctuations: Final sale prices may differ from estimates.
- Shipping Risks: Insured separately; we’re not liable for carrier delays/loss.
- Arbitration: Disputes resolved via binding arbitration in South Dakota.
7. Termination
We may refuse service if:
- You breach these terms.
- Items are misrepresented or illegal.
8. Governing Law
These terms are governed by South Dakota law.
